Terms of Service

These Terms of Service ("Terms") govern access to and use of FringeTrack (the "Service"), operated by Wenhao Zhang, an individual doing business as FringeTrack ("we," "us," "our"). By visiting fringetrack.com or subscribing to the Service, you ("you," "Customer") agree to these Terms.

1. Feature availability

FringeTrack is an active, paid service, but it is still under active development and not every feature described in our marketing pages is available on every plan yet. Each plan's pricing page states which features are currently live and which are still in progress. We only charge for a plan's price once you've subscribed to it, regardless of whether every listed feature on that plan has shipped — check the current plan pages at fringetrack.com before subscribing if a specific feature is what you need. We will notify subscribers by email of material changes to what a plan includes.

2. The Service

FringeTrack converts payroll data you upload into certified payroll reports: federal WH-347 on every plan, plus state-specific formats and other features on paid plans as described on our pricing page, along with fringe-benefit tracking against prevailing wage determinations. FringeTrack does not process payroll or pay wages, is not a substitute for your payroll provider, accountant, or legal counsel, and does not submit reports on your behalf to any government or general-contractor system — you remain responsible for the actual filing.

3. Accuracy of your data

You are solely responsible for the accuracy and completeness of the payroll data you upload and for the accuracy of every report FringeTrack generates from it. FringeTrack helps organize and format your data; it does not independently verify wage rates, classifications, or hours. You remain responsible for compliance with Davis-Bacon, Copeland, and applicable state prevailing-wage law, and for reviewing each report before submission to a contracting agency.

4. Plans, billing, and payment processing

Subscriptions (Starter, Pro, Bookkeeper) are billed monthly with no setup fee. Payments are processed by Creem, our payment processor and merchant of record. Creem may bill and collect payment on our behalf, and Creem's own terms and payment policies apply to the transaction. See our Cancellation & Refund Policy for details.

5. Your account and acceptable use

• You must provide accurate account information and keep your login credentials secure.
• You may not use the Service to upload data you do not have the right to use, or to violate any law.
• You may not attempt to reverse-engineer, resell, or provide the Service to third parties as your own product without our written consent.

6. Intellectual property

FringeTrack and its underlying software, templates, and content are owned by us or our licensors. You retain all rights to the payroll data you upload. We do not claim ownership of your data and use it only to provide the Service to you, as described in our Privacy Policy.

7. Disclaimer of warranties

The Service is provided "as is." We do not guarantee that generated reports will be accepted by any federal, state, or general-contractor system, or that the Service will be uninterrupted or error-free. FringeTrack does not provide legal, tax, or accounting advice.

8. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, including fines, penalties, or lost profits arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the three months before the claim arose.

9. Termination

You may cancel your subscription at any time (see Cancellation & Refund Policy). We may suspend or terminate access to the Service for violation of these Terms, non-payment, or unlawful use.

10. Changes to these Terms

We may update these Terms as the Service develops. We will post the updated Terms here with a new "last updated" date, and for material changes we will notify active subscribers by email.
